ABSTRACT
Since offensive abuses of religious confessions have less and less impact on collective conscience, part of the doctrine considers religious sentiment can no more constitute a value worthy of specific criminal-law protection in a laic and secular legal system and hopes abolition of the provisions which garrison it, proposing that conducts, which are today specifically sanctioned, fall within the protection of ordinary penal rules defending common assets.
The autor, noting that a conception of laity that overlooks the specificity and the anthropological centrality of the question about God cannot but arouse perplexity, critically highlights that assimilation of faiths as ideologies would constitute a fictio juris unfit to grasp unassimilable realities and would be contrary to a pluralist oriented legal system, in which integral protection of human personality needs a specific protection of religious sentiment too.
