ABSTRACT
The contribution analyses the case that led to the decision of the Second Section of the Council of State no. 2567 of 2024, which declared unlawful the ordinance of a mayor imposing to display the crucifix in all municipal offices. After analyzing the first-instance ruling and briefly setting out the findings of the ruling of the United Sections of the Supreme Court on the display of crucifixes in school premises, the work concludes by criticizing the way in which the Council of State used the principles set forth by the United Sections in order to declare the unlawfulness of the mayor’s ordinance.
