ABSTRACT
Recent technological innovations in the field of information technology and the use of artificial intelligence tools or predictive algorithms, increasingly used in secular contexts (think of the civil telematic process), do not seem to directly affect the systems judiciary of a religious nature. However religious rights have also met the need for speed and concentration, which seem to be further fueled by the latest technological advances in the field of information technology and telecommunications. Consider the recent reform of the cano- nical marriage process carried out with the Motu Proprio Mitis Iudex of 2015, which gave rise to a shorter process in the presence of some indications of nullity.
Outside the strictly procedural framework, digitization and technological progress greatly affect the exercise of the right to religious freedom. In addition to the use of in- formation technology and specific Apps, the transformation concerning the Islamic world is of particular interest, especially in non-Islamic contexts. Think to the phenomenon of online fatwa and to the proliferation of virtual preaching centers, sometimes close to the environments of radicalism and terrorism. However, this leads to the risk that minor hadith are conveyed on the web as absolute and incontestable truths, without the confessional authority having adequate means to counter these positions.
The paper intends underline that, at present, pending the necessary intervention of the legislator, the substantial protection of the right to religious freedom seems to be guaranteed only by the ability of the single platform (Facebook, Youtube) to control and repress illicit and misleading uses of the technological medium through the preparation of appropriate Regulations.
