ABSTRACT

The increase in migratory flows towards the countries of the Global North has led to growing cultural and religious diversification, creating opportunities for enrichment but also significant challenges. The presence of Muslim communities in Western contexts has raised questions about freedom of thought and religion, in a context where political and social responses vary widely. While some countries demonstrate more inclusive approaches, others adopt secularism policies that can be oppressive. The contribution high-lights the complexities of religious governance and the need to balance different interests, such as those of the minor and the mother. The ECtHR has underlined the importance of considering cultural and religious background in legal decisions, to avoid discrimination and ensure respect for identities. This issue poses a fundamental challenge for modern societies, requiring a more conscious and inclusive approach to managing diversity.
