Nr. 2/2025ALESSANDRO FERRARI De la démocratie militante à la militance du pluralisme. Pour une liberté religieuse au-delà du droit
ABSTRACT
The article focuses on the civil recognition of religious entities, with particular reference to the delicate relationship between the naming of religious entities and legal qualification. A recent case law ruling highlights the tensions between confessional autonomy, legal specialty, and associative pluralism, highlighting how the demand for exclusive use of the name can limit the freedom of new religious communities or autonomous associations. The document therefore emphasizes the function of naming as a dynamic tool for identity governance, capable of mediating between the internal autonomy of denomination, reputation protection, public trust, and associative pluralism, with implications also for Third Sector law.
