ABSTRACT
The essay deals with the particular competency that the Court of Cassation of the Vatican City State had from 1961 to 1997 as the Supreme Court of the Sovereign Order of Malta. The genesis and the reasoning behind this unique disposition (art. 24, § 6), contained in the Constitutional Charter of the Sovereign Order of Malta promulgated in 1961, is reconstructed thanks to consultation of unedited archival documentation. The study also analyzes the relationship between the Vatican juridical order and the legal system of the Order of Malta (with regard to the civil procedural Code), as well as the cases of the Sovereign Order of Malta treated by the Vatican Court of Cassation.
